I got a mail from another person, named Sindhav Jayadeep, who suffers from a similar physical condition. Below is the email conversation that went between him and me today. I have requested him to keep me updated on whatever follows in his case. I consider this to be another fight for one's right to begin here.

Well, I can understand that the Rajkot officials must be novices. There is much of a chance that they do not know the rules themselves! So, you can only pity them.

Here is what you should do now:-



Go first to the office of the transport department which issues the license. Ask them to give you a form to fill up for the learning license. They cannot deny you the form because it is your right. Or may be you can also find the form outside in the market for a few rupees.

Fill this up. The learning license form throughout India should be the same. This form also contains a form of medical fitness. In your case it is mandatory to get it filled and signed by a government doctor (Eye Specialist) along with his seal and registration number.

You need to get this medical certificate (i.e. their medical fitness form) signed and submitted along with other forms and supporting documents (address proof etc.).

Once you get the medical form signed by the doctor go back to the office and ask them to accept your application. (By the way, before you submit the medical certificate to them, you must get a copy of it secured for your for later references because you might need it later on.). If this time the officials at the Rajkot Transport Office denies to accept your application and give you a learning license, ask them to give you that in writing. There is a fair chance that they will deny. But what you can do is to try to convince them there is no such rule in the Transport Act of India, which applies throughout the country. You can also show them the RTI reply I got from the Delhi Transport Headquarters which explicitly says that if you have given the medical certificate and fulfill all the requirements as mentioned in the form, you can drive and no can deny you a license.

If they still deny you you a learning license then first ask them to give you that in writing. After that you should file an RTI in the same office asking for reasons of denying you a license. If they give you that in writing, they may lose their jobs. Because there is no such rule in our constitution or anywhere else in the world.

First you do this and then let me know what happens. You will have to fight for your rights here, because there are a few duffers in many government offices who sitting there just for the sake of their jobs and do not know much about their responsibilities.

One more thing, as you might have noted, I am running a website also where I bring out such issues and give information about such cases out to the people. As I am responding to you, may I also ask you for your permission to update all of this conversation and the ensuing ones to upload there on the website?

Hi Jaydeep,
Good that you shared your experience with me. Sure, I will do whatever I can to help you. But before that please tell me something more about you, like from where you are and which Office did you go to get the license.
Never get it done through a tout. Though you can get it, you will feel bad about it and it might also later become problematic.

If you can drive it, there is no law in the INdian constitution that can bar you from getting the license unless the doctor specifically says. And remember, no doctor can say until you another eye just normal with or without spec. You can drive and with a legal license!

Hi Priyan,
The Driving License is a personal document and that is why I have some reservations in sharing this with you here. If an official denies you this, you just ask to say the same thing in writing. Ask them to reject your application. This will give you a reference document. You can also file an RTI in the same office asking them the questions I have asked. Remember that if he gives that in writing, he will risk his job. And if you file an RTI, he has to reply it within 45 days at most.
